Changes to statutory sick pay

Statutory Sick Pay will increase from £81.60 to £85.85 per week. The change will take effect from 9 April 2012.

However, please remember that a business only needs to pay statutory sick pay to employees who qualify.

To qualify an employee must have:

  • been sick for more than 4 consecutive days (including non-work days)
  • average earnings of at least £95 per week before tax and National Insurance are deducted
  • notified you that they are sick

It is important that businesses comply with these changes. If failing to do so, employees could make a claim against a business for unlawful deduction from wages and/or breach of contract.
